The judge scheduled a new hearing for Friday.
"The Defendant shall be present at argument as the Court, if necessary and appropriate, will amend the mandatory minimum portion of the sentence," read a court order filed Tuesday.
In a memo from his office to the Montana attorney general's office, attorneys had argued the relevant statute was "misapplied and the minimum sentence that could be imposed in Rambold's case was two years" -- anticipating the judge's Tuesday order.

Montana state prosecutors are appealing a controversial ruling in which a judge sentenced a former teacher to only 30 days in jail for raping a 14-year-old girl who later committed suicide.
Prosecutors are appealing the sentence as "illegal," according to the Associated Press.
The appeal came the day after District Judge G. Todd Baugh moved to hold a hearing to determine whether the sentence should be increased to two years.
"In this court's opinion, imposing a sentence which suspends more than the mandatory minimum would be an illegal sentence," Baugh wrote in a order filed Tuesday. The court order stated that state law seems to require a two year mandatory minimum, not 30 days.
He said that prosecutors did not "object or otherwise inform the court on the issue of the applicable mandatory minimum" until after the sentencing.

BILLINGS — The Montana Supreme Court has overturned a one-month prison sentence given to a former high school teacher convicted of raping a 14-year-old student.

Wednesday’s decision cited in part the actions of District Judge G. Todd Baugh of Billings, who suggested the young victim shared responsibility for her rape because she had some control over the situation.

Justices said a new judge must re-sentence defendant Stacey Dean Rambold.

A disciplinary complaint against Baugh from the Judicial Standards Commission is pending with the state Supreme Court. Justices say that will be dealt with separately.
