The constitution does have lots of other rules, against unreasonable search and seizure for example. Tennessee also has a constitution. It might become a constituional argument at some point, since the actions of private citizens could be unconstituional if they are permitted/funded by unconstituonal laws or government action. But yes, in this case common law and regular statutory law should be enough to judge this situation.
