Scientology appears already to have had an objection sustained as to Debbie Cook not having shown that DM is connected to FSO. However, it seems that a lot of their case is premised on Cook's email having disparaged DM. To carry their burden of proof, Scn will have to establish that somehow, DM is one of the third parties protected by the contract. Considering that they have spent considerable resources trying to maintain deniability about DM's lines into the cult, they prefer to keep it all "ecclesiastical," and they are dependent on maintaining a fluidity of the claims they can make about DM's relation to the cult, it is seriously not in their interest to make any definitive statements. Carrying their burden of proof presents some very serious problems for Scientology. They can default on it and lose the case, or they can be tied down to one version by estoppel.
