    The owner of a US website accused of breaking Australian law by the Australian Human Rights Commission has told them to rack right off.
    Encyclopaedia Dramatica is a tasteless collection of articles along the lines of Sickipedia or Something Awful.

    ED is refusing to bow to demands from the AHRC that it remove an article about aborigines.

    The AHRC letter accuses the site's largest shareholder, Joseph Evers, of breaching the Australian Racial Discrimination Act. It said it had received 20 complaints about the website.
    The AHRC insists that the site should follow Australian law because, although the site is hosted in the US, with free speech protection, articles which can be read and downloaded in Australia are considered to have been published in Australia.
    Evers insisted in his blog that the site would never bow to censorship and that Aussie users would be able to see the site "up until the point that your God-forsaken government blocks it with their soon-to-be-implemented secret list of banned material".
    The site was blacklisted by the Australian Communications and Media Authority during the trial of the country's censoring firewall.
    The article on aborigines was also removed from Google's Australian search results earlier this year. As Joseph Evers put it in his blog: "This was right after Google had done a large amount of grandstanding about fighting Chinese censorship. Which proves they’re a bunch of spineless hypocrites."
    One of the site's moderators gave a rather brilliant interview to Nine News which includes a quote from Matthew 15.11 - "Not that which goeth into the mouth defileth a man; but that which cometh out of the mouth, this defileth a man." Wise words indeed.
    Evers has been advised by his lawyer to steer clear of Australia.

    Notice how it has gone from "ban child porn" to "ban something that offends some people". It's like I said, it's not about the porn, it's about control. After Scientology, internet censorship is next on the "to do" list.

    The last I check the united states isn't under Australian jurisdiction so they have no authority over encyclopedia dramatica. I don't care who they are trying to kid anyway since the internet is owned by no one and they shouldn't be casting their lines into it anyway. All i can say to them is piss off

    It's too bad people in Oz are thought to be complete idiots by their government. Then again, given the same people making those decisions were elected by the Australians, they're probably right.

    The only problem is this:

    There's a precedent. A ridiculous one, but still a precedent.

    Also, what I find ridiculous is the idea that not only is the entirety of the site on the ACMA blacklist, but the page in question has been removed from google.com.au search results.

    If Australia can't view the page, what is there to press charges about?

    I'm deeply grateful to the Founding Fathers for including a Bill of Rights in the United States Constitution, and, in fact, refusing to pass the Constitution without it. When governments don't, shit like this happens. Question for citizens of the People's Republikkk of Australia: Can decisions made by Australian federal courts be appealed to London as part of their membership in the Commonwealth, or are those apron strings well and truly severed? Then again, that probably wouldn't help...

    Agree. Whoever responded to that interview... well done. The questions were heavily slanted and often loaded, and the responder did a great job of cutting through the BS, unmasking flawed premises, and refuting both the explicit and implicit.

    The guy can easily just claim the articles are for satire and parody. Also, Encyclopaedia Dramatica has the right to offend, Australia doesn't have the right to not be offended.

    The problem with the dickheads in Australia is is that ED can point to the US constitution and say "Oh, lookie, you're trying to extradite us for using our free speech rights". The US government *CANNOT* sign such an extradition, no matter how much it might wish it were so.

    I totally agree with that moderator - free speech with limits is not free (take a note, RFW). It's a simple fact that you can't have your cake and eat it. Free speech means being able to say things that people don't want you to say - whether it's trolling or arguing against the political status quo. If you make it so that nobody can say anything that offends anyone, you can't say a damn thing.

    Yeah, Encyclopedia Dramatica can be pretty shocking at times, but that's the way it goes. It's designed to shock, infuriate and provoke. There are articles that make a lot of racist jokes and there are articles that make a lot of jokes at the expense of racists. I'd argue that, by taking offensiveness to the extreme, ED makes the people who genuinely hold those views look ridiculous and therefore takes the bite out of their hate speech. How about you ban Mel Brooks' films next? Or South Park?

    The only thing that bothers me about this is that with Xenophon pushing for an investigation into the CoS, the CoS in Ausland will play the Racist = ED = Anonymous = Opposition to Scientology game.

    Funny thing is when I lived in AU nobody I met had anything nice to say about the "Abbos" and most of the "Abbos" I saw were passed out on the sidewalks
