    No. Australia and US have excellent extradition relations. Some civil law countries, notably France won't extradite their own citizens. That is not the case in the US and Australia [both are common law countries], where extradition does not depend on nationality, but rather on the location where the crime occured.
    Had she held a French citizenship, then I would have been worried.

    Quickie update She is in Downing Centre Court and that is in (NSW) New South Wales and it is a max of 14 years there not 25 as I posted. That is for another section of Australia.
    Here is the exact charge:

    CRIMES ACT 1900 - SECT 319

    General offence of perverting the course of justice
    319 General offence of perverting the course of justice

    A person who does any act, or makes any omission, intending in any way to pervert the course of justice, is liable to imprisonment for 14 years.

    What the Law States according to NSW Law for Pervert the course of justice

    According to NSW Law for the charge of Pervert the course of justice,

    Besides, she'd have to go to the U.S. Embassy & lie that she'd lost her passport & needed a temporary one to fly back to the U.S. I suspect if authorities confiscated her passport, advisories would have gone out to the embassy & custom officials about her arrest. Jan is, effectively, stuck in Oz.

    Looking at the criminal code I don't feel it will be hard to prove the case. There are enough credible witnesses to do that. Where Jan can get really fucked is if the government can prove as a result of her actions that the molestation of the daughter continued or some other harm was suffered by her or her mother as a result of the coverup. If the daughter is allowed to give a victim impact statement in the sentencing phase it will really hurt Jan Eastgate in a bad bad way.

    I bet Scientology would ask her to do "the end of cycle", like they did with Steve Fishman. That would be fun if they started sending her all sorts of poisonous things to ingest in prison.

    May even be placed in Protective Custody Cell all by her lonesome?

    Cons don't like sex offenders OR those who obstruct justice in punishing one.

    And even when countries don't have extradition treaties, extraditions are always possible based on reciprocity basis. That's really not an issue.

    Her only defence against extradition can be "political or religious exception", i.e if the charges against her are improperly motivated and are based on her religious or political beliefs. US courts used to refuse extradition of IRA bombers to the UK, based on the political exception. Knowing Scientology, I"m sure they'll try this argument.

    While this is correct for Victoria, the correct length in NSW is 14 years according to the Crimes Act 1900 - Section 319 reads as follows:

    Additionally she could be charged with Hindering investigation under S315 which is liable for 7 years (http://www.austlii.edu.au/au/legis/nsw/consol_act/ca190082/s315.html) or threatening or intimidating a witness under S315A which is 7 years (http://www.austlii.edu.au/au/legis/nsw/consol_act/ca190082/s315a.html) or alternatively, Concealing a serious indictable offence which is 2 years (or 5 is she benefited from it) under S316 (http://www.austlii.edu.au/au/legis/nsw/consol_act/ca190082/s316.html)
    I'd say the three points about intent and causation would remain a constant across states.

    They said she had to surrender her passport. But I would presume that if she has dual citizenship, someone explored the possibility that she has two passports, and made sure she turned over both?

    This certainly is NOT an isolated incident of child abuse by any means, the fact it was perpetrated on a young girl who was a sexual abuse victim by the Citizens Commision for Human Rights International's leader, Jan Eastgate shows just how pervasive it is in Scientology.

    This is the most powerful person in Scientologys hierarchy to deal with human rights abuses, instead she threatened this little girl and obstructed justice in her sexual abuse case to protect the image of Scientology.

    This crime was brutal and this young girl is remarkable to stand up to this hypocritical, abusive cult.

    Imho,This phony bitch, Jan Eastgate should fry for this because of her position. She'll follow Hubbard policy and commit perjury, "for the greater good" and all.

    Please go through the 970,00 entries for many more incidents never mind the ones that were covered up and not exposed.

    Hubbard's Children's RPF in and of itself is child abuse, imho as are many of his abusive policies, child labor abuses and on and on...ad nauseum....

    handcuffs and charges. The damage this cult/sect does to children, is unforgiveable. BASTARDS!!!

    By the way- there is something really sad about all those Sea Org members that were never allowed to have kids, and as a result all they've got is Scientology. It's difficult for them to all of a sudden realize that they've invested their entire life energy in that bullshit. Not to justify Jan Eastgate's behaviour - but she just looks sad to me.

  39. After I read Nancy Many's book, I realised that the reason IMHO they don't want them to have children is that it creates a competing priority and forces you to think about how your life is going to change. That is a recipe for quitting the Sea org.

    Interesting where this all leads:

    Scientology is run by the Sea Org.

    The Sea Org don't breed.

    The Sea Org need to acquire young minds early to indoctrinate to replace staff.

    The only people who will give up their children to Scientologists are staff or public.

    Staff and public talk to each other and learn over time that if you hand your kids over you never see them again.

    Most Scientologists don't want them to give up their children.

    The more they do give up their children, the less paying members will be born in the next generation.

    As far as expansion goes, they have the same problem as the Quakers, only slower. Left to their own devices, without changing, they would eventually disappear.

    So the Sea Org is engineered to be predatory on children, particularly children of people who know nothing about Scientology.

    This explains why most of the Sea Org people in Sydney are foreign (usually Taiwanese), and why they have a propaganda machine in Taiwan to make the Sea org look exotic and affluent and nothing like the 80 hour week for no money that it actually is.
