I'd have to read the law but I think the way compliance works (which is counter to many things) is that the accused has to prove them wrong.

Granted the DMCA is front loaded with under penalty of perjury so in theory people would not post up false ones.

Pretty sure their system is automated as they expect most claims to be valid and any one who falls under fair use is going to respond.

EFF are the ones who have been hammering on their enforcement under false claims. The angle on that would be to be able to force youtube to have to track down the false claimants either by passing it off to the feds or by altering their system to innocent until proven.

It's a good tact, gregg might be able to do something with it. Chances are we'd need a copyright lawyer up in this mother to figure out what's possible.

If your point had any validity (and I'm not trying to diss you or anything), it would be against the law/rules/policy/whatever for people to be able to delete comments from their own channels for the same reason you're stating here.

If that were the case, any time you deleted a comment not your own (not saying YOU personally would), someone would have grounds for a case against you.

We need to emphasize to YouTube that the Cult is abusing their systems, and is committing fraud and perjury. Had this have been Anonymous DMCA-ing Scilon videos, we'd be charged so fast our meat would spin.

The double-standard is downright appalling.

I see here a new door opening because now they have confirmation who owns the account and if they take him to court he is fucked. There might be moar to the story as we currently see. They have not lost anything because the videos have been up for a long time. All they got is solid confirmation of account ownership and reach a potential objective. Calling this a full win will not cover-up that they got information.

There is a difference between suspicion and verified facts. This is the first time the account was publicly linked to him. Remember, it's about collecting evidence - a reason why they take us to court not the other way around. Sorry AgentPubic just is another excample of this. They collect until we slip and like a shark attack.

Gregg could just be the copyright agent. He isn't necessarily the person who started the account in the first place, but he obviously has some degree of control over the account now.

See you don't think and I don't care if you call me DM, O$A or POPE but you should understand what is going on. They collect data and store it for further use. Now that he has been publicly linked to the account, he can be made responsible for the content on the site. He stated that he is the owner, not just a caretaker of the account which leaves him exposed. I might just have to much tinfoil on the roof but I don't make the mistake to underestimate these guys. The cult is not dead yet and they will try to strike again.
