Two corrections:

1. I don't know where you get your data that most civil cases are based on contract law, but it's an odd thing to say. In any event, it's irrelevant. Whatever the cause of action in a suit by an ex, the defendent can claim that the action is statute-barred. However, a plaintiff can argue that the defendent shouldn't be allowed to rely on the statute of limitations in cases where the defendent doesn't have "clean hands", for example if the defendent misled the plaintiff about the facts or their rights, or tried to intimidate the plaintiff into not taking action or held them captive... See the Submission on the SOL application in the Marc Headley matter for detailed arguments; and
2. Any civil action is independent of criminal action and would not need a criminal conviction at all. If both civil and criminal actions were on foot, the civil action would be stayed (postponed) to allow the criminal to go ahead first. But that doesn't mean the criminal is necessary for the civil action. Rather, it's so that the civil proceedings don't interfere with the defendent's right to a fair trial.
