    i heard something about a witness wishing to give evidence anonymously against a london businessman for fear of danger if identified. not sure if that case is what triggered it though but heard about it recently on the news in relation to this

    We should get something like that in the US. I know last year, Congress passed the much vaunted John Doe law. Maybe that will help.

    Scientologists will be backing this as well. They might use it for false evidence and such.

    A Law Lords ruling that a certain case was unsound due to the use of anonymous witness testimony. It had wide-reaching implications for other, and future, cases.

    It sounds like it'd be a good law (if you only read the meeja soundbites) but it is some seriously shitty legislation. Almost as bad as Labour's proposal to abolish trial by jury to "speed up" the court system...

    This 'sounds' like good law, but isn't. It means if someone gives evidence against you then your barrister is unable to point out that the person has had a long-standing grudge against you, is on drugs and generally is mental because the barrister will never learn any of this as they are giving evidence anonymously.

    At the very least, this really doesn't sound like something you'd want "rushed through Parliament".

    Yes although there is tons of very good learned opinion on this - it's called the House of Lords judgement in which they all said it was a very bad idea. They made the decision for policy reasons not based on a silly reading of existing legislation.

    The Law Lords made an infinitely reasonable decision that the accused has a right to know who is giving evidence to try and convict them, so that the accused can mount a proper defence.

    The politicians bawwwed because it may make it harder to convict people for gang violence. True perhaps, but not a good enough reason to remove another one of the crucial safeguards that keep our legal system fair.

    Also, unlikely to have any relevance to Chanology, certainly not one that's positive for us as far as I can see. Conceivably it could be used to allow scientologists to give false evidence about us without giving us the ability to go "hang on, that's David Miscavige, he has a vested interest in lying about me".
