No, it said simply that there was a "'loud confrontation' with Montalvo, which turned physical." From that, brain-dead lizard people WWP users immediately concluded that "Beghe hit Daniel Montalvo". OSA smiled.

Was there ever an obit posted on this in Oz? I can't find any mention of his death here in the States.

Regardless of what actually occurred, if in fact their argument had become physical, it could pose problems for Jason. He was convicted on 2/24/2011 in Malibu after pleading no contest to simple assault on the process servers (represented by Rick Moxon). He had to pay a shitload of assessments totally $564 and was placed on probation for 12 months with the order he must "obey all laws". Moxon has also filed a civil suit against Jason on behalf of the process server.

DM & Moxon are determined to run Jason into the ground..literally. They were already pissed at him for the widely publicized coverage of his blowing Scientology and trashing it.. now he's aligned himself to Marty. Now it's all about retaliation & vengeance.

From a Google search of his name, it looks like he's a Legal Aid lawyer, ya know, one of those free ones you get:

Don't know. Bryan Seymour said on tv that he was dead.

Wait WUT. Scientology used a FREE lawyer? How is this possible?

Edit: Remember that leaked email from not too long ago that said Jan needed to raise some money to 'fight the psyches in court'? Perhaps that was her legal fund and they didn't get enough. Although really this doesn't sound very plausible, what with the massive amount of support she had on the day. Those scientologists at court could of easily coughed up $10000 for Jan.

Sounds plausible. There was only one under his name on a search of the bar records that were posted earlier too. The only way he wouldn't be is if sometime between now and November last year he moved out of Legal Aid into private practice.

Gontolmonz, Jan Eastgate, International Head of the CCHR and top ranking Scientologist has a government funded lawyer.

Many UK lawyers who do legal aid cases also do private cases. Is this the same in Australia? We need to find out if she is being paid for by Australian tax payers when she is not a resident or running a business there.

Why? She's still a legal resident of Australia and entitled to all rights of a citizen there... http://www.dfat.gov.au/facts/legal_system.html

Most lawyers in the US and British system donate some of their time to do charity work, in the from of legal aid. If some TV is right, and they seldom were. Many parts of the world have that.
  17. thefatman Member

She's a citizen of Aus, not a resident, but either way she gets the same rights.

It's possible that her lawyer is in private practice and has done pro bono work on the side but they wouldn't have been listed in the media reports (that I've linked earlier) as a Legal Aid lawyer if that were the case.

I think we should all recognise the hard decision that Carmen Rainer made in coming forward. Without her courage, none of this would have happened. It would be nice to see Jan convicted, but even if she isn't, more people will come forward because of this and Scientology will have to be very careful in how they handle situations like this in the future. This is one hugh step for reforming one of the worst aspects of Scientology.

    Anonymous salutes you Carmen.

Now that I think of it, one reason there was such a hive of scientologist activity on the day - in particular with shielding Jan and OSA cameras - was probably because they thought Carmen would show up.

I think they are very afraid of the people who can come forward, and so they should be! And with anonymous around no amount of scientology muscle will shudder them to silence (scilence?) again.

It will not end well for Scientology. Whether it's this particular case, or others that are yet to come, but the general direction of Scientology is DOWN.
They lost their scare edge - people are no longer afraid of them. Shit, I would have never dared to give my real name to Scientologists in 2007 after calling them anti-psychiatry freaks. But in 2011, everything goes. There is not a day that goes by that there is a negative article about Scientology in the media. They are not winning this game. They are still violent and nasty, but they going down.

As Carmen said, "it's okay to speak out, you don't have to be scared anymore, cause they can't hurt you."
