If he gets a TRO will it mean that he can't protest at the org without somehow nullifying it? A TRO is supposed to protect you from someone who might harm you. So if you go to a location where you know that person lives/works/worships xenu, doesn't it mean you didn't really need the TRO?

He struck me as being a staffer because he's wearing the same blue shirt typical of Sea Org staff that work in maintenance and janitorial posts, but wearing sneakers would be a big no-no. On the other hand, unless this guy is an ill-tempered lout not associated with the cult, what was his motive for attacking Tommy? Seems like alot of anger being vented for simply being a visitor to the org.

Tommy can contact the SFPD on Monday, speak to a detective, and try to get the man's name. The SFPD, historically, have not been as redneck as the LAPD.

If, in fact, the culprit is a Scilon, Tommy's chances of getting a TRO against him are nil, if Tommy wants to continue protesting at the org. It would only take a Scilon attorney to inform the court that this guy works at the org. Tommy can't prevent someone going to their home or place of work.

If he's a public, one can't get a TRO preventing one from attending their place of worship. He could get a TRO to prevent the guy from approaching him at his home & work location, but a judge would probably note that Tommy needed to stay away from Scientology properties for the TRO to remain in effect.

Absolutely not true. He can have it set with no distance but condition to no touching and no verbal contact, I have seen that done many times. It would not matter if the guy was charged by the the police from that point on. If he puts his hands on Tommy or says anything he will be violating the TRO. Also there is a side entrance and it could be argued that he needs to use that if he sees Tommy but I doubt the judge would enforce that. None the less it would be worth the effort to try.

In general restraining orders are pretty common sense, just "He stays away, you stay away"

You're free to disagree. I've seen alot of TRO applications in cases and the judge does not get involved in issues of who's right & who's wrong. If this bozo is a staffer at the SF Org, and Tommy is protesting there, regardless what Tommy is saying or doing, a Scilon attorney only needs to make the case that Tommy is there to provoke the guy into getting angry. Also, a judge would not require a Scilon to use a side entrance to avoid Tommy. LOL. The org is a place of business. The judge will give more credence to a staff member of the org versus an ex-member protesting it.

The judge, if he were to approve a TRO, could require Tommy to protest the org from across the street . It would sustain his constitutional rights to protest, but establish a buffer zone that prevents the guy from coming in close contact with Tommy when he goes to & from the workplace.
