    If a "church" member got punched in the face while leaving their org would that be a hate crime?

    How come a legal protestor isn't able to file civil rights violations when the cult does it???

    How does the assault on Tommy infer it was due to his racial group, religion, sexual orientation, disability, class, ethnicity, nationality, age, gender identity, social status or political affiliation? The hate crime legislation is precise. http://en.wikipedia.org/wiki/Hate_crime

    § 241. Conspiracy against rights
    If two or more persons conspire to injure, oppress, threaten, or intimidate any inhabitant of any State, Territory, or District in the free exercise or enjoyment of any right or privilege secured to him by the Constitution or laws of the United States, or because of his having so exercised the same…they shall be fined not more than $10,000 or imprisoned not more than ten years, or both; and if death results, they shall be subject to imprisonment for any term of years or for life.

    I can’t tell how I am getting this, I do not want her to get into trouble. If she knew I was posting this on line he would kill me, but seeing that video tilted it for me.

    So this guy Chris evidently has a felony conviction for armed robbery. He spent time in prison. He tried to join staff but because of his time in prison for such a crime, he did not qualify. I am told he is a problem and is a “tough case” and a heavy druggy, but because of his brother and sister in law donating so much money they put up with him, plus they get him to pay also, evidently he got some big inheritance. I was told in the millions.

    You really do need to take a course in law & the courts before you post stuff out of thin air. This statute only applies if the case is to be heard in the federal court. It won't.

    It's under the jurisdiction of the San Francisco Superior Court where this statute has no relevence.

    I received info of the same from a source which I'm investigating. Christopher inherited some $$ from his father's estate after his dad, a Castro Valley dentist, died in 2008.

    Chris has his Scilon brother, Dan, and another brother, Mark, who lives in Hawaii. They are all on Facebook, as are Chris' relatives in California, Oregon & Washington.

    This info makes even more sense in that Chris does not appear in the cult's completion lists. I assume the cult removed his name because of the bad PR potential from his criminal past. Plus, his Linked In site where he uses...Tone30.. is a clue.

    The point was the law will side on the "hate" not "free speech" because it is a "religion"

    Reviewing the Shasta County records, numerous tax troubles seemed to follow Chris' brothers & son as well, with tax liens all released in 2010.. if the father died in 2008, after probate issues were resolved, it stands to reason the family came into some money. Alot of tax bills were paid in full in 2010.

    I have no doubt that they worked the guy up. Also seeing the truth that your cult is a fraud in the form of protesters standing outside your ORG all the time must drive one a bit nuts.

    Nobody in the SF cell has seen this guy before. Add the fact that they watch/harass the Gormans on a regular basis, me thinks the org imported some angry confront to intimidate TGTG.

    Wrong. ("The case"? What case? The criminal assault? The tort of assault civil action? Not talking about either one.)
    He could bring this statutory action in Federal court. It deals with violations of Constitutional law.
    Research the history of this provision, and why it was enacted.
    And then go to your books and look up the next section. And then get the horn book on Federal Jurisdiction. There will be a quiz.
    There are many Federal actions one can file anywhere, even when there are other state claims.
    If one were stuck with local law there would be no need for federal law.
    Where you think someone would have to be to utilize this statute?

    True that. You can file a lawsuit wherever you want. Demurrer or motion to dismiss is the next step for a defendant and (a) they have to defend and (b) if well pled, a case survives demurrer/MTDband will continue to summary judgment, settlement, or trial.

    Okay, have to caveat the "wherever you want." Jurisdictional issues matter, but in this case, federal question could trump... But, fed judges much tougher sell than the staties, IMO.

    Not a matter of trumping. A simple assault can also constitute a violation of the Federal statute.

    I thought it was amusing that his niece (Mark's daughter Alyssa Ann K., 19) was recently jailed in Chico for drunk&disorderly/resisting/fake ID, but I'm doubtful that Mark & family are even scilons, so probably of little value beyond lulz.

    If Tommy has a good lawyer, things should be interesting. I am looking forward to seeing what will take place in the next week or two.

    You can needless chatter all you want to prove your point, but federal statutes are not applicable in a state case. The SFPD & the SF DA processes cases through the Superior Court. The assault was not a federal crime.

    Tommy can file a federal civil rights action if he wants, which would be a civil case, not criminal.
