It's an "add-on" offense in that you have to be already committing a crime before they can add that offense. (Like carrying a slim jim on the street isn't an offense, but in a burglary, it's an add-on "burglary tool" charge.) It wouldn't apply to non-violent Anonymous style protests. Of course, how the cops apply it might not have anything to do with the letter of the law.
