Just because the federal law adheres to one party consent it does not therefore follow that you can ignore more stringent state laws when calling from a one party state to a two party state. Federal law only preempts state wiretapping laws which are less restrictive than federal law. Commonwealth v Look, 379 Mass. 893 (1980). A caller from a one-party state calling into a two party state is violating the law of the two party state, and if he/she is otherwise subject to that state's jurisdiction (which is another question entirely), the two party state may charge the caller from the one party state.
